Here's an excerpt:
A holiday accommodation is bindingly booked if a room, holiday apartment or holiday home is booked by the guest and confirmed by the landlord/hotelier or made available for short-term bookings. A binding accommodation contract or guest accommodation contract is generally concluded without a form, i.e. also in the case of verbal booking, in particular by telephone. This is unless the contracting parties have expressly agreed in writing.
If a binding accommodation contract has been concluded, the following shall apply:
once it's booked, it's booked.
None of the contracting parties is permitted to unilaterally withdraw from the concluded agreement, regardless of the reason/s for the cancellation (except when there's a case of force majeure). Bad weather, illness and even death in the immediate family do not justify withdrawal from the contract. However, the parties may agree to amicably terminate the agreement. In this case, the landlord/hotelier can demand the agreed or customary rental price minus their saved expenses from the guest. The time of withdrawal does not count. Even if, for example, the guest cancels the accommodation contract six months before the planned arrival, they remain obliged to pay the agreed or customary rent. However, the landlord/hotel owner must allow saved expenses to be offset against their claim. The value of the saved expenses for overnight accommodation with breakfast flat rate of 20%, for overnight accommodation with half board flat rate of 30% for overnight accommodation with full board flat rate of 40% and for rental of a holiday flat or a holiday house flat rate of 10% of the accommodation price is recognised as appropriate by the courts.
However, the landlord/hotelier is obliged in good faith to assign the booked accommodation elsewhere in order to keep the damage as low as possible.
Many accommodations use flat cancellation fees in their general terms and conditions. The cancellation conditions regulate the amount of the cancellation fees depending on the time of cancellation. This is a voluntary regulation - usually more favourable for the guest - to which the landlord/hotelier is not obliged and which must be expressly agreed by the parties.
It is not only the guest who has obligations towards the landlord/hotelier arising from the accommodation/guest accommodation contract concluded. The landlord/hotelier is obliged to provide the guest with the room in accordance with the agreement. The landlord/hotelier is in any case responsible for the failure to provide the room due to overbooking. In this event, they must pay compensation to the guest. If the guest has to move into another, more expensive room in such a case, for example, the guest can claim the difference as damage.
