Cancellation by the Tenant
The tenant may withdraw from the lease before the start of the rental period by written declaration to the landlord. The relevant point in time is when the landlord receives the notice of withdrawal.
If the tenant withdraws from the lease, they must pay a lump sum compensation for the expenses already incurred by the landlord and the lost profit as follows:
Cancellation 45 days before the start of the rental period: 20% (but at least 60.00 EUR)
Cancellation 30 days before the start of the rental period: 50%
Thereafter, in case of no-show: 80%
The tenant is entitled to prove that the landlord has suffered no damage or significantly less damage.
Upon cancellation, the tenant may nominate a substitute tenant who is willing to take their place in the existing contractual relationship. The landlord may object to the entry of the third party if they appear to be economically or personally unreliable.
If a third party enters into the lease, they and the previous tenant are jointly and severally liable to the landlord for the rent and any additional costs arising from the entry of the third party.
The landlord is obliged to act in good faith to re-let an unoccupied property and must offset any savings against the cancellation fees claimed. There is no entitlement to a reduction in the rental price if the tenant terminates the lease early (departure/break-off).
The tenant is advised to take out travel cancellation insurance.
