General Booking Conditions for the Hotel and Restaurant Industry
1. The accommodation contract is concluded as soon as the room has been ordered (booking) and confirmed (confirmation). Confirmation is binding in both oral and written form.
2. The conclusion of the accommodation contract obligates the contracting parties to fulfill the contract, no matter the duration of the contract.
3. The landlord is obliged to compensate the guest for damages if the room is not provided.
4. The guest is obliged to pay the agreed or customary price for not taking advantage of the contractual services, minus the expenses saved by the landlord. According to standard rates, the savings amount to 10% for overnight stays (holiday apartment), 20% of the overnight price for bed and breakfast, 30% for half-board, and 40% for full-board. The guest is at liberty to prove that the host has incurred no or significantly lower compensation than the aforementioned cancellation fee.
5. The landlord is in good faith obliged to try to re-let rooms that are not claimed, in order to avoid losses.
6. Until the room is re-let, the guest must pay the amount calculated according to number 4 for the duration of the contract.
7. The exclusive place of jurisdiction is the location of the business.
