General Booking Conditions for the Hotel and Restaurant Industry
1. The accommodation contract is concluded as soon as the room has been ordered (booking) and confirmed (confirmation). Confirmation is binding in both oral and written form.
2. The conclusion of the accommodation contract obligates the contracting parties to fulfill the contract, regardless of the duration for which the contract is concluded.
3. The landlord is obliged to compensate the guest for damages if the room is not provided.
4. The guest is obliged to pay the agreed or customary price for not making use of the contractual services, minus the expenses saved by the landlord. According to empirical rates, the savings amount to 10% for overnight stays (holiday apartments), 20% of the overnight price for bed and breakfast, 30% for half board, and 40% for full board. The guest is free to prove that the host incurred no or significantly lower compensation than the aforementioned cancellation fee.
5. The landlord is obliged in good faith to allocate rooms that are not used, if possible, to avoid losses.
6. Until the room is rented out again, the guest has to pay the amount calculated according to number 4 for the duration of the contract.
7. The exclusive place of jurisdiction is the place of business.
